The purpose of this privacy policy (this "Privacy Policy") is to inform users of our Site of the following:
1. The personal data we will collect;
2. Use of collected data;
3. Who has access to the data collected;
4. The rights of Site users;
5. Our email communications; and
6. The Site's cookie policy.
This Privacy Policy applies in addition to the terms and conditions of our Site.
By using our Site users agree that they consent to:
1. The conditions set out in this Privacy Policy; and
2. The collection, use, and retention of the data listed in this Privacy Policy.
Consent to receive email from us is separate. We ask for it with a specific yes-or-no question, it is optional, and it is not part of your agreement to use this Site (see "Email from Cape Clarity" below).
We only collect data that helps us achieve the purpose set out in this Privacy Policy. We will not collect any additional data beyond the data listed below without notifying you first.
Data Collected Automatically
When you visit and use our Site, we may automatically collect and store the following information:
1. IP address;
2. Location;
3. Hardware and software details;
4. Clicked links;
5. Content viewed;
6. Date and time of visit;
7. Referring website;
8. Website interaction duration;
9. Estimated age group and gender; and
10. Traffic source.
This information is collected using website hosting and measurement tools, including Webflow, Google Tag Manager, Google Analytics, and Google Ads conversion measurement.
Data Collected in a Non-Automatic Way
We may also collect the following data when you perform certain functions on our Site:
1. First and last name;
2. Email address; and
3. Phone number;
Where it is collected:
• Free-consultation booking form. Your name, email address, phone number, your appointment time, the reason you are exploring support, and your yes-or-no answer to our email question. This is held in Zoho Bookings and Zoho CRM, which we use for scheduling and contact management.
• Support group and website signup forms. Your name, email address, and the group or list you signed up for. These are held in Zoho CRM.
• Client intake, scheduling, clinical, and payment information. Collected through SimplePractice, a third-party HIPAA-compliant platform used for client intake, scheduling, and secure communication. Insurance claims are processed through Headway.
• Feedback surveys. If we invite you to share feedback about your experience, your responses are collected through Zoho Forms. We do not ask for your name or any contact details in the survey, so your responses are not linked to you. They are not used for marketing.
We use Zoho Bookings and Zoho CRM under a business associate agreement, and fields that may contain health information are specially marked and restricted to authorized staff.
Data collected on our Site will only be used for the purposes specified in this Privacy Policy or indicated on the relevant pages of our Site. We will not use your data beyond what we disclose in this Privacy Policy.
The data we collect automatically is used for the following purposes:
We use automatically collected data to understand how visitors interact with our website, improve performance and content, identify trends, measure whether our advertising brings people to the Site, and ensure the site is functioning securely and effectively.
We use the information submitted through SimplePractice to provide therapy and wellness services, manage appointments, and communicate with clients.
We use the information you submit on our booking and signup forms to schedule your consultation or group, to contact you about it, and, only if you said yes, to send you the optional emails described below.
Who We Share Personal Data With
Employees - We may disclose user data to any member of our organization who reasonably needs access to user data to achieve the purposes set out in this Privacy Policy.
Third Parties - We may share user data with the following third parties (service providers that help us run the practice):
1. SimplePractice (client intake, scheduling, records, and payments);
2. Zoho (booking, contact management, automation, and email)
3. Webflow (website hosting);
4. Zoom (telehealth and consultation video calls);
5. Headway and Mentaya (insurance billing and out-of-network reimbursement, only when you use them); and
6. Google Analytics and related Google measurement tools (Tag Manager, Ads conversion measurement).
We may share the following user data with third parties:
1. Health and scheduling information submitted through SimplePractice; booking and contact information submitted through our forms; and
2. Anonymous or aggregated technical and usage data.
We may share user data with third parties for the following purposes:
1. Client intake and service delivery; scheduling and communication; and
2. For website analytics and performance monitoring.
Service providers that handle protected health information for us sign a business associate agreement with us. Third parties will not be able to access user data beyond what is reasonably necessary to achieve the given purpose.
We do not send what you enter on our booking or signup forms, or any health information, to analytics or advertising tools.
Other Disclosures - We will not sell or share your data with other third parties, except in the following cases:
1. If the law requires it;
2. If it is required for any legal proceeding;
3. To prove or protect our legal rights; and
4. To buyers or potential buyers of this company in the event that we seek to sell the company.
If you follow hyperlinks from our Site to another Site, please note that we are not responsible for and have no control over their privacy policies and practices.
We sometimes send occasional emails with resources, blog posts, support group and event announcements, and practice news. We send them only to people who have said yes: wherever we ask, for example on our free-consultation booking form (where we ask a yes-or-no question), in our new-patient paperwork, or on a signup form on this Site. Saying yes is optional and has no effect on your care or on your consultation. If you say no, we do not send these emails.
Topics. Your emails are organized by topic. Depending on where you sign up, we may start you on topics we think are relevant, based on the signup you used, and we invite you in a welcome email to choose the topics you want (for example cancer support, caregiving, chronic pain, or chronic illness, plus support groups and events, and practice news and blog). You can add or remove topics at any time, or unsubscribe from everything, with the "manage preferences" or "unsubscribe" link at the bottom of every email, or by contacting us.
Where your information is kept. When you say yes on the booking form, our automation copies your name and email address, and a record of your yes, into our contact system (Zoho CRM). Our email tool receives only your name, email address, whether you have opted in, and your topics. It never receives diagnoses, clinical notes, appointment details, or insurance information. Because topics can reveal a health interest, we protect them like the rest of your records.
Feedback requests. From time to time we may email you to ask about your experience. These come from a separate system, are not marketing, are not used for marketing or testimonials, and you can stop them with the link in each message.
Testimonial requests. After your care with us has ended, we may email you to ask whether you would be willing to share a testimonial. These requests are separate from feedback requests and from the emails above. We never publish anything about you without your written permission for that specific testimonial, and you can say no or stop these requests at any time.
Messages that are not marketing. Appointment reminders and clinical, billing, and administrative messages are not affected by these choices.
Questions. Contact our privacy officer, Dr. Liana Preudhomme, at info@capeclarity.com or (239) 837-8879.
How Long We Store Personal Data
User data will be stored until the purpose the data was collected for has been achieved. You will be notified if your data is kept for longer than this period.
How We Protect Your Personal Data
To protect user data, Cape Clarity limits the collection of sensitive information through its public website. Client health, payment, and intake information is collected and stored in SimplePractice, Zoho Bookings and Zoho CRM, which we use under business associate agreements. Fields that may contain protected health information are specially marked. Access to this data is restricted to authorized clinical and administrative personnel only. Staff are bound by confidentiality agreements and undergo privacy training to ensure compliance with legal and ethical standards. While we take all reasonable precautions to ensure that user data is secure and that users are protected, there always remains the risk of harm. The Internet as a whole can be insecure at times and therefore we are unable to guarantee the security of user data beyond what is reasonably practical.
The minimum age to use our website is 18 years of age. We do not knowingly collect or use personal data from children under 13 years of age. If we learn that we have collected personal data from a child under 13 years of age, the personal data will be deleted as soon as possible. If a child under 13 years of age has provided us with personal data their parent or guardian may contact our privacy officer.
How to Access, Modify, Delete, or Challenge the Data Collected
If you would like to know if we have collected your personal data, how we have used your personal data, if we have disclosed your personal data and to who we disclosed your personal data, or if you would like your data to be deleted or modified in any way, please contact our privacy officer here: (Clinical records are kept for the periods the law requires and may not be deletable on request. You can stop marketing email, or ask us to delete your marketing record, at any time.)

A cookie is a small file, stored on a user's hard drive by a website. Its purpose is to collect data relating to the user's browsing habits. You can choose to be notified each time a cookie is transmitted. You can also choose to disable cookies entirely in your internet browser, but this may decrease the quality of your user experience. We use the following types of cookies on our Site:
1. Functional cookies - functional cookies are used to remember the selections you make on our Site so that your selections are saved for your next visits;
2. Analytical cookies - analytical cookies allow us to improve the design and functionality of our Site by collecting data on how you access our Site, for example data on the content you access, how long you stay on our Site, etc; and
3. Third-Party Cookies - third-party cookies are created by a website other than ours. We may use third-party cookies to collect anonymous usage data for analytics purposes, to measure the results of our Google advertising, and to ensure the proper functionality of embedded tools or services such as our booking and signup forms.
You can control cookies through your browser settings.
While we are committed to protecting user privacy, our website is not intended to collect clinical information. The only health-related information you might enter on the Site is what you choose to provide on our booking and signup forms (for example, what kind of support you are seeking). That information goes to our HIPAA-covered systems (see "How We Protect Your Personal Data") and is not sent to analytics or advertising tools. All clinical and health-related data is securely processed through SimplePractice, a HIPAA-compliant platform.
Cape Clarity does not respond to ‘Do Not Track’ signals from web browsers, as there is currently no uniform standard for how such signals should be interpreted.
This website is not monitored for emergency messages. If you are experiencing a crisis or emergency, call 911 or go to your nearest emergency room.
This Privacy Policy may be amended from time to time in order to maintain compliance with the law and to reflect any changes to our data collection process. When we amend this Privacy Policy we will update the "Effective Date" at the top of this Privacy Policy. The latest update added our email program, described the systems that hold booking and contact information, and expanded our list of service providers. We recommend that our users periodically review our Privacy Policy to ensure that they are notified of any updates. If necessary, we may notify users by email of changes to this Privacy Policy.
